Garbage Collector Revises Lawsuit Against Yorktown

Frontline Waste Management, which is doing business under the name Competition Carting, was awarded the bid in October. The company will now be run by Joseph Spiezio, who also manages R&S Waste Services in Harrison. Competition Carting President Brian Amico announced the change in a letter to the Westchester Solid Waste Commission that was read by Council Member Nick Bianco at Tuesday night's Yorktown Town Board meeting.

Because of the management change before the company begins its contract on Jan. 1, C.R.P. believes the town "awarded a bid to an entity that never even put in a bid."

In a memorandum filed in state Supreme Court, C.R.P. accuses Spiezio of using Amico and Competition Carting to avoid the vetting process, and had always planned to take over the business after it was awarded the bid.

Spiezio, however, said Amico will still be in charge of all operations.

"I'm taking an executive role in the company," Spiezio said. "We brought in equity funds to assist in the transition to Jan. 1. And under my leadership we brought in multiple talented people that were in the industry in excess of 30 years."

Spiezio said he was hired by the company to work in the same capacity he does with R&S and with 22 other waste management companies.

"Everything that's being done is to make the company stronger and healthier financially," Spiezio said. "That's my job as chairman."

Bianco said the Town Board will bring Spiezio in for a  meeting at next Tuesday’s work session at town hall, though Spiezio said he had not yet been contacted by the town and was unaware of the desire to meet.

The contract has been a point of contention for some residents who believe the risk of an inexperienced garbage collector outweighs the savings. Competition Carting's contract was $500,000 less than the bid by C.R.P., which has held Yorktown's contract for seven years. 

Supervisor Michael Grace previously brushed off C.R.P.'s lawsuit and said "it has no merit whatsoever." Grace's confidence in Competition Carting appeared unshaken at Tuesday night's board meeting..

“I guarantee you that your garbage will be picked up,” Grace told residents. The supervisor added that the company's trucks are scheduled to be licensed Wednesday and should be ready to go by Jan. 1.
